Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of the relations in the field of use of the electronic digital signature.

Article 2. Legislation on the electronic digital signature

The legislation on the electronic digital signature consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about the electronic digital signature then are applied rules of the international treaty.

Article 3. Basic concepts

In this Law the following basic concepts are applied:

the electronic digital signature - the signature in the electronic document received as a result of special information transforms of the furnished electronic document with use of private key of the electronic digital signature and allowing to establish by means of public key of the electronic digital signature lack of misstatement of information in the electronic document and to identify the owner of key of the electronic digital signature;

private key of the electronic digital signature - the string received with use of means of the electronic digital signature known only to the signing person and intended for creation of the electronic digital signature in the electronic document;

the certificate of key of the electronic digital signature - the electronic document confirming compliance of public key of the electronic digital signature to private key of the electronic digital signature;

the owner of key of the electronic digital signature - physical person or legal entity to which the certificate of key of the electronic digital signature is issued;

public key of the electronic digital signature - the string received with use of means of the electronic digital signature, corresponding to private key of the electronic digital signature available to any user of information system and intended for confirmation of authenticity of the electronic digital signature in the electronic document;

confirmation of authenticity of the electronic digital signature - positive result of check of accessory of the electronic digital signature to the owner of key of the electronic digital signature and lack of misstatement of information in the electronic document;

the electronic document - the information fixed electronically, confirmed with the electronic digital signature and having other details of the electronic document allowing to identify it.

Article 4. Conditions of recognition of equivalence of the electronic digital signature and sign manual

The electronic digital signature in the electronic document is equivalent the sign manual in the paper document in case of simultaneous observance of the following conditions if:

authenticity of the electronic digital signature is confirmed;

the certificate of key of the electronic digital signature affects the moment of confirmation of authenticity of the electronic digital signature or at the time of signing of the electronic document in the presence of the proofs determining the signing moment;

the electronic digital signature is used for the purpose of, specified in the certificate of key of the electronic digital signature.

The electronic document certified by the electronic digital signature of the legal entity is equated to the paper document certified by seal the legal entity in case of simultaneous observance of the conditions specified in part one of this Article.
